Welcome to Bloom. These Terms of Service ("Terms") govern your access to and use of our website and your purchase of the Bloom Portable Blender. Please read them carefully.

1. Introduction & Acceptance

By accessing, browsing, or purchasing from our website (the "Site"), you agree to be bound by these Terms and our other posted policies. If you do not agree, please do not use the Site.

  • You must be at least 18 years old to make a purchase.
  • By placing an order, you confirm that you are 18 or older and legally able to enter into a binding contract.
  • These Terms apply to all visitors, customers, and anyone else who accesses the Site.

If you are using the Site on behalf of someone else (for example, buying a gift), you are still personally responsible for following these Terms.

2. About Bloom

Bloom is a single-product e-commerce brand that sells the Bloom Portable Blender in the United States. We operate online only.

3. Use of the Site

You may use the Site for personal, non-commercial purposes, including browsing products and placing orders.

  • Scrape, crawl, harvest, or otherwise extract data from the Site using automated tools
  • Place fraudulent, fake, or speculative orders
  • Impersonate another person or misrepresent your identity, payment information, or shipping details
  • Interfere with or disrupt the Site, its servers, or its security features
  • Attempt to gain unauthorized access to any part of the Site, other user accounts, or our systems
  • Upload or transmit viruses, malware, or any harmful code

4. Account Information

You can shop on the Site as a guest, but you may also create an account for a faster checkout experience.

If you create an account, you agree to:

You are responsible for all activity that happens under your account. We are not liable for losses caused by your failure to keep your credentials secure.

5. Products, Pricing & Availability

We sell the Bloom Portable Blender at the price displayed on the Site at the time of purchase.

  • All prices are listed in U.S. Dollars (USD).
  • Prices, promotions, and availability may change at any time without notice.
  • We make reasonable efforts to ensure pricing is accurate, but errors can happen. If we discover a pricing error after you place an order, we may cancel the order and issue a full refund.
  • We reserve the right to refuse, limit, or cancel any order at our discretion, including for suspected fraud, ordering in suspicious quantities, or pricing errors.
  • Product availability is not guaranteed. If an item becomes unavailable after you order, we will notify you and refund the affected amount.

6. Order Acceptance & Payment

Clicking "Place Order" submits an offer to buy. Your order is not accepted until we ship the product. Until that point, we may decline or cancel the order for any reason permitted by law.

  • We process payments through Shopify Payments and other payment providers Shopify supports.
  • We do not see, store, or have access to your full credit card number. Card data is handled directly by the payment processor.
  • You agree to provide a valid payment method and authorize us (and our payment processor) to charge it for your order, including taxes and shipping fees.
  • If a payment is declined, reversed, or charged back, we may cancel the order or pause future orders until the issue is resolved.

You will receive an order confirmation email shortly after checkout, and a separate shipping confirmation when your order is dispatched.

7. Shipping

Shipping timelines, methods, and any related fees are described in our separate Shipping Policy, which is incorporated into these Terms by reference. Please review it before placing an order.

8. Returns & Refunds

Returns are governed by our separate Return Policy, which is incorporated into these Terms by reference. Eligible returns must be initiated within 30 days of delivery. See the Return Policy for details on condition, process, and refund timing.

9. Product Information & Disclaimers

We do our best to describe the Bloom Portable Blender accurately, including its specifications, features, and product images. However:

  • We do not guarantee that descriptions, photos, colors, or specifications are 100% accurate, complete, or current.
  • Product images are for illustration. Actual appearance may vary slightly based on lighting, monitor settings, or production batches.
  • The Bloom Portable Blender is sold as-is for personal, non-commercial use. It is not intended for industrial or commercial food preparation.
  • Always read and follow any included usage instructions and safety warnings before use.

If you receive a product that is materially different from what was advertised, contact us and we will work to make it right under our Return Policy.

10. Intellectual Property

All content on the Site is owned by Bloom or its licensors, including:

  • Logos, brand names, and trademarks
  • Product photography and graphics
  • Website copy, headlines, and marketing text
  • Page layouts, design elements, and code

You may view and share Site content for personal, non-commercial purposes (for example, sending a friend a product link). You may not:

  • Copy, reproduce, modify, or distribute content for commercial purposes
  • Use Bloom branding or imagery to sell, market, or promote competing products
  • Remove or alter any copyright or trademark notices

All rights not expressly granted in these Terms are reserved.

11. User-Generated Content

If you submit reviews, photos, comments, testimonials, or other content to the Site or to Bloom directly ("User Content"), you grant Bloom a worldwide, royalty-free, perpetual, non-exclusive, transferable license to use, reproduce, modify, publish, and display that content for marketing and operational purposes.

You also represent that:

  • The User Content is yours, or you have permission to share it
  • It does not violate any third-party rights or any law
  • It is honest and not misleading

We may moderate, edit, or remove User Content at any time, for any reason, without notice. We are not obligated to publish or keep any submission.

12. Disclaimer of Warranties

The Site and the Bloom Portable Blender are provided "as is" and "as available" without warranties of any kind, either express or implied.

To the fullest extent allowed by law, we disclaim all implied warranties, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Any warranties arising from course of dealing or usage of trade

We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any defects will be corrected.

Some states do not allow the exclusion of certain implied warranties, so portions of this section may not apply to you.

13. Limitation of Liability

To the fullest extent permitted by law:

  • Bloom's total liability to you for any claim arising out of or related to these Terms, the Site, or the Bloom Portable Blender is limited to the amount you actually paid for the product giving rise to the claim.
  • Bloom is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or loss of goodwill, even if we have been advised of the possibility of such damages.

You agree to defend, indemnify, and hold harmless Bloom and its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your misuse of the Site or the Bloom Portable Blender
  • Your violation of these Terms
  • Your violation of any law or third-party right
  • Any User Content you submit

We reserve the right to assume the exclusive defense of any matter for which you owe us indemnification, and you agree to cooperate with our defense.

15. Governing Law
